Student Loan Bankruptcy Discharge
Reopening Closed Bankruptcy Cases
Chapter 7 & Chapter 13 Student Loans
CAN STUDENT LOANS BE DISCHARGED IN BANKRUPTCY?
Yes. Student loans can be discharged through bankruptcy in certain circumstances.
At Lynn Law Group, our Florida bankruptcy attorneys help borrowers explore whether their federal or private student loans may qualify for discharge through bankruptcy.
Student loan discharge generally requires a separate legal proceeding called an adversary proceeding, in which the borrower must establish undue hardship. Updated federal guidelines introduced in November 2022 have created a more streamlined process for evaluating certain federal student loan discharge cases.
Already filed bankruptcy? You may still have options. In some circumstances, we can seek to reopen a closed Chapter 7 or Chapter 13 bankruptcy case to pursue student loan discharge! So even if another attorney handled your original bankruptcy, we can be hired to reopen that bankruptcy to pursue a student loan discharge!
Based in Fort Myers, Lynn Law Group serves clients throughout Southwest Florida, including Naples, Cape Coral, Bonita Springs, and Estero, as well as eligible clients statewide.

New Student Loan Bankruptcy Guidelines Are Making Debt Relief More Accessible
For years, many Americans believed that student loans were virtually impossible to discharge in bankruptcy. As bankruptcy attorneys, that was often what we told clients in consultations. But changes introduced by the U.S. Department of Justice and Department of Education in November 2022 have helped make the student loan bankruptcy discharge process more accessible for qualifying borrowers. We are so excited to now offer this to our clients!
And the results are encouraging.
A December 2025 New York Times article highlighted research finding that approximately 87% of borrowers who pursued student loan discharge through the newer bankruptcy process successfully discharged most or all of their student loan debt!
The updated federal guidelines provide a more standardized process for evaluating undue hardship, including a borrower's income, necessary living expenses, and financial circumstances. Although student loan discharge is not automatic and eligibility depends on each borrower's situation, these changes have created meaningful opportunities for people struggling with overwhelming student loan debt.
At Lynn Law Group, our Fort Myers bankruptcy attorneys help clients throughout Florida explore whether they may qualify for student loan discharge through Chapter 7 or Chapter 13 bankruptcy.
Even if you completed your bankruptcy several years ago, you may still have options. In certain circumstances, a closed bankruptcy case can be reopened to pursue student loan discharge through a separate adversary proceeding.
